General terms and conditions of use
 
1. Acceptance
 
Access to the Syclef.fr site, its consultation and use are subject to the unreserved acceptance of the present Syclef.fr General Conditions of Use.

2.1. Copyright and related rights
 
All the elements making up the Syclef.fr site (texts, graphics, software, photographs, images, sounds, plans, names, logos, brands, various creations and protectable works, databases, etc.) as well as the site itself, are covered by French and international legislation on copyright and related rights, in particular articles L.122-4 and L.122-5 of the French Intellectual Property Code.
 
These elements are the exclusive property of SYCLEF, with the exception of elements created by external contributors to the Syclef.fr site who have not transferred their copyright or related rights.

 Consequently, the user of the Syclef.fr site undertakes not to:

  • use or query the Syclef.fr site on behalf of or for the benefit of others,

  • reproduce in number, for commercial purposes or not, creations, information, or photographs present on the Syclef.fr site

The name "SYCLEF" is a registered trademark owned by SYCLEF. Any use of this trademark - or any other trademark owned by SYCLEF as a result of its activity - which is not expressly authorised may incur the civil and/or criminal liability of its author. SYCLEF reserves the right to take legal action against any person who infringes its rights.
 
3. Protection of personal data
 
In accordance with the EU General Data Protection Regulation 2016/679 of 27 April 2016 and the French Data Protection Act of 6 January 1978 as amended, any person concerned by the processing of personal data has the right to access their data, to object to the use of their data, to rectify, delete and port their data. They also have the right to restrict the processing of their data, not to be the subject of a decision based on automated processing, and to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés.
 
SYCLEF collects personal information about users only when they apply for a job (www.carrieres.syclef.fr).
The information collected is processed confidentially by the duly authorised human resources staff of SYCLEF, by an external recruitment agency which SYCLEF may, if necessary, call upon, and by the IT service providers involved in the implementation of the Syclef.fr website, for the sole purpose of analysing the content of the CVs sent by the user and to proceed with recruitment procedures.
 
No personal information is collected without the user's knowledge, nor is it processed for unintended purposes.
 
With the user's consent, SYCLEF also uses cookies to monitor and analyse the performance, operation and efficiency of the Syclef.fr website.

 4. Responsibilities
 
SYCLEF declines all responsibility in the event of temporary impossibility of access to the Syclef.fr site (and/or sites linked to it) due in particular to :

  • technical maintenance operations or updating of published information,

  • technical problems, whatever their origin and source, and in particular in the event of destruction of equipment, attack or hacking, deprivation, deletion or prohibition,

  • temporary or definitive impossibility - including breakdowns or unavailability inherent in the hosting servers - of access to the Internet network

  • direct or indirect damage caused to the user, whatever the nature, resulting from the content, access or use of the Syclef.fr site (and/or sites linked to it), as well as the impossibility of using the Syclef.fr site (and/or sites linked to it)

  • abnormal use or illicit exploitation of the Syclef.fr site. The user of the Syclef.fr site is then solely responsible for any damage caused to third parties and the consequences of any claims or actions that may result. The user also waives the right to take any action against SYCLEF in the event of legal proceedings being brought against him/her by a third party as a result of the illegal use and/or exploitation of the site.

SYCLEF reserves the right to take legal action against any person who does not comply with the provisions of articles 323-1 to 323-7 of the French Penal Code, and in particular who fraudulently accesses all or part of an automated data processing system on the Syclef.fr website.

Users who have access to software published by third parties (in particular Google Maps published by Google), via the Syclef.fr website, use them under their sole responsibility. Each user of Google Maps declares having previously accepted the conditions of use of Google and Google Maps.
 
Consequently, neither SYCLEF nor any of its partners or agents may be held liable for any damage of any nature whatsoever in relation to the information and services offered on the Syclef.fr website.
 
SYCLEF does not guarantee the completeness, accuracy, updating or exhaustiveness of the information and services made available. SYCLEF makes every effort to provide users with quality content.

7. Modifications to the General Conditions of Use
 
SYCLEF reserves the right to modify, freely and at any time, the General Conditions of Use of the Syclef.fr website. Each user connecting to the Syclef.fr site is invited to regularly consult the General Conditions of Use in order to take note of any changes. Renewed use of the site as and when these General Conditions of Use are modified constitutes acceptance, by each user, of the General Conditions of Use in force.
 
8. Attribution of jurisdiction - applicable law
 
The fact that SYCLEF does not take advantage of any of the provisions of these General Terms of Use at a given time may not be interpreted as a waiver of the right to do so at a later date.
 
Any disputes that may arise concerning the validity, interpretation, acceptance and performance of these Terms of Use, regardless of the place of subscription or payment, will be subject to an attempt at amicable settlement that the parties undertake to seek. If no amicable settlement is reached within one (1) month of written notification of such a dispute, the courts of Aix-en-Provence shall have sole jurisdiction, even in the event of a third party claim or multiple defendants, for emergency or protective proceedings, in summary proceedings or by petition.


These General Terms and Conditions of Use are governed by French law, which determines the applicable law on a case-by-case basis. In the absence of any mandatory provision to the contrary or in the presence of a choice in determining the applicable law, French law will be applied.
